Our friends at The Employee Rights Advocacy Institute For Law & Policy published a fascinating set of timelines of Supreme Court decisions, attached below. Over the past 40 years, the Supreme Court has authorized employers, banks, and payday lenders to avoid litigation over unlawful practices by forcing individuals to pursue claims for violations of their rights, in arbitration. This trend of Supreme Court decisions clearly contradicts one of the most fundamental rights in America–the right of access to the courts for redress. We appreciate the Institute’s work and encourage ongoing legislative efforts to restore the rights of individuals to seek redress in courts.
